In recent years, elder law has become a dynamic and fast-growing area of the law, dealing with concerns such as estate planning, financing of nursing home care, retirement benefits, healthcare provisions, and the legal protection of the elderly when they become incapacitated. Public Medical Assistance for Nursing Home Care

Of critical interest to my clients is providing for the staggering cost of nursing home care while retaining the ability to provide a legacy to one's family and loved ones. In February 2006, new laws went into effect which make it more difficult to use an aggressive program of gifting in order to lower a person's assets with the objective of becoming eligible for subsidized nursing home care.

I assure my clients that gifting programs to accomplish this aim are still possible, though they require more foresight, planning, and the advice of an experienced elder law attorney. When a client first meets with me to discuss this issue, we carefully review the client's financial situation and the client's desires regarding assets they would like to pass to family members. I then draw up a plan which clearly shows what resources they will be able to keep, what resources they must give up, and a gifting timetable.   

Financial Concerns, Personal Considerations

Looking beyond asset protection and other financial considerations, I consider the personal consequences of the transition for clients and their families. While I can advise the client on the legal implications of the decision he or she makes, ultimately the decision is the client's to make, based on personal and family concerns.

For an incapacitated person who can no longer make decisions about their personal and medical care, and who does not have an adequate power of attorney, I can I can assist in the appointment of a guardian for the protection of the person and their assets.
